Our Contract

These Terms and Conditions govern the supply of goods sold by Koilogic.co.uk to the customer named on the order form provided on the Koilogic.co.uk website. Together with the completed order form, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.

We reserve the right to cancel any order where an item has been incorrectly priced. Our contract to provide goods offered on this website starts when we accept payment of your money, and your order is marked as despatched.

Price & Payment

The price payable for the goods you order is as set out on our website at the time you place your order, where pricing errors have been made they will be notified to you and you have the option to either cancel your order or accept the correct price, plus any charges for carriage set out in the order form.

We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage before your order can be accepted unless we have agreed otherwise in advance in writing.

Delivery & Title

Unless you tell us you wish to collect the goods, we will deliver them in accordance with your order. If your goods are sent by courier or recorded post a valid signature will be required on delivery. If you choose to add a delivery instruction to your order to leave in a safe place or with a neighbour, this will be done at the courier driver's discretion and at your own risk.  A signature will not be required for 1st and 2nd class Royal Mail. Immediately prior to despatch of the goods to you, title of the goods will pass to you.

Availability

Most of our products listed are held in stock, whilst we endeavor to ensure sufficient stock is held to meet all orders in a timely manner, if we have insufficient stock (due to selling out) to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted product or refund you the price paid for such goods as soon as possible and in any case within 30 days.

Cancellation & Returns

You may cancel your order by giving us notice of cancellation by phone within 7 days of the date of delivery. Such notice may be given by telephoning or emailing to the number or address shown on this website. If you are canceling because of any problem with the goods, please notify us of the problem at the time of cancellation.

On cancellation, you must return the goods to us at your cost unless the goods are being returned because they are faulty on arrival, incorrect goods or because of unsuitable substitution by us, in which case we will meet the cost of return but we ask that you allow us to nominate the carrier. The maximum postage cost we will refund per parcel is £6.50 Please phone first before returning any parcel to us.

All returns must be completed within 28 days of receipt of goods.

Liability

If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer.

Termination

We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.

General

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law. These Terms & Conditions are subject to change without notice.

Everything on this site, from the photographs and graphics to the text of these terms, is either owned by us or used by us with someone elses permission. By using our site, you will not obtain any rights in any of the materials on our site. While you're welcome to view the site and print hard copies of anything on it for your own personal use, you are not allowed to copy or use anything on our site for any other purpose, such as any business or commercial use. In addition, you are not allowed to modify, distribute or re-post anything on our site for any purpose at all unless we tell you otherwise.

 

Koi Logic Direct - Terms for the delivery of live Koi

As the Sole U.K. Import Agent for the Ogata Koi Farm, Japan, Koi Logic has many years experience importing and handling 100s of thousands of Ogata Koi, giving you peace of mind knowing your purchased Koi will arrive in safe condition.

All Ogata Koi offered for sale have been quarantined at Koi Logic for a minimum of four weeks after arrival from the Ogata Koi Farm, Japan.
All Ogata Koi offered for sale will have been checked to ensure they are healthy, feeding well, and full of vitality before being sent.
All Ogata Koi are sent in purpose designed cargo boxes as used by the Ogata Koi Farm when sending Koi to Koi Logic, a journey of over 5800 miles and 20 + hours.
All bags will be filled with the correct water to oxygen ratio to ensure safe arrival.
Claims:In the very unlikely event that a Koi is found dead on arrival the following steps must be followed.
1. A photograph of the dead Koi in the unopened bag must be emailed to sales@koilogic.co.uk before 2pm on the day of arrival.
2. All replacement Koi will be sent on a like for like basis and will be included with your next purchase.
3. Any refunds offered by Koi Logic will be by way of a credit note against you next purchase of Koi.
4. Only claims which have met step 1 will qualify for any form of replacement or credit.
5. All claims will be handled on an individual basis.
6. Once you have signed for the delivery of Koi you will now be deemed the owner of those Koi.
7. The Koi you now own must be cared for, if in doubt please seek advice without delay.
8. Under no circumstances will Koi Logic be held responsible for any Koi you purchase from Koi Logic or existing fish you own, once your new Koi have been introduced to your pond or quarantine system.
 

Please rest assured, we are a long standing professional company who only purchase Koi from the Ogata Koi Farm, Japan.
All Koi held at Koi Logic have only been imported from the Ogata Koi Farm, Japan and have never come in to contact with Koi from any other source.
We ensure you of our best intentions at all times.
